Image Policies

By submitting, uploading, or displaying any images, graphics, or visual content ("Images") to The National Tile Installation Registry or the Tile Heritage Foundation ("Service"), you agree to abide by the terms set forth in this Policy.

1. Warranties and User Representations

By submitting an Image, you represent and warrant that:

You are the original creator and copyright owner of the Image, OR you have obtained all necessary licenses, rights, consents, and permissions from the copyright owner to submit and publish the Image on our Service.

The Image does not infringe upon, misappropriate, or violate any third-party copyright, trademark, patent, trade secret, privacy right, publicity right, or any other legal or moral right.

The Image complies with all applicable local, state, national, and international laws.

The image is real, as the National Tile Installation Registry is a platform for historical preservation it does not accept simulated visualizations of installations or tile.

 2. License Grant

By submitting Images to the Service, you grant [Registry/Platform Name] a worldwide, non-exclusive, royalty-free, transferable license to host, store, cache, reproduce, display, and distribute the Image solely in connection with operating, displaying, promoting, and providing the Service.

3. Prohibition of Infringing Content

We maintain a strict zero-tolerance policy for copyright infringement. Users are explicitly prohibited from uploading Images taken or created by third parties without express, written permission from the rights holder.

4. DMCA Notice and Takedown Procedure (Safe Harbor)

The Tile Heritage Foundation respects the intellectual property rights of others and expects its users to do the same. Pursuant to 17 U.S.C. § 512(c), we have implemented the following procedure to respond to notices of alleged copyright infringement.

 

Filing a Takedown Notice

If you believe that your copyrighted Image has been uploaded to our Service without authorization, please send a written notification to our Designated Copyright Agent containing the following information:

      1. Physical or Electronic Signature of the person authorized to act on behalf of the copyright owner.
      2. Identification of the Copyrighted Work claimed to have been infringed (or a representative list if multiple works are covered).
      3. Identification of the Material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material (e.g., exact URLs).
      4. Your Contact Information, including your name, address, telephone number, and email address.
      5. A Good Faith Statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
      6. A Statement under Penalty of Perjury that the information in the notification is accurate, and that you are authorized to act on behalf of the copyright owner.

Upon receipt of a valid, compliant notice, we will act expeditiously to remove or disable access to the allegedly infringing Image.

 

Counter-Notification Procedure

If you believe your Image was removed or disabled by mistake or misidentification, you may submit a written counter-notification to our Designated Agent containing:

  1. Your physical or electronic signature.
  2. Identification of the Image that was removed or disabled and the location where it appeared before removal.
  3. A statement **under penalty of perjury** that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, telephone number, and email address.
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the U.S., any judicial district in which the Service may be found), and that you will accept service of process from the person who provided the original DMCA notice.

Upon receipt of a valid counter-notice, we will forward it to the original complaining party. If the complaining party does not file a court action within 10–14 business days, we may restore the removed material.

Repeat Infringer Policy

Pursuant to DMCA requirements, The Tile Heritage Foundation will, in appropriate circumstances and at its sole discretion, terminate the accounts or access rights of users who are deemed to be repeat infringers.
